Notice to Cease Habitually Late Rent

I have a tenant who habitually pays rent late. Sometimes, including last month, she has been 35 days late. I have sent her letters that are somewhat informal that have said "you must pay the rent by the 15th or I will have to ask you to leave. It seems that maybe the apartment is not affordable for you any longer"

She does not have a lease. She is month to month so in my Notice to Cease I should just say Month to Month rental and keep all the rest of the language the same??

Or do I have I right to send her a NTC since she has no lease???

Depends on your state or local laws. In South Carolina, verbal leases are recognized. If a tenant has a lease then goes month to month, we both are still bound to the original lease terms.

We evict the same way whether they are month to month or in a written lease.

Thank you for your advice I am a property manager in Georgia but just got hired in South Carolina and there anywhere for me to find out the laws here for evictions
