Minimum Age in TN?

We are developing our first property in TN and would like to be 21 and up. Can anyone who is currently in TN provide any feedback on this? Are any of you 21 and older communities? Is this legal in TN?

Charlotte, I don't believe this is legal anywhere due to Fair Housing laws. The only age-related restriction that a community can make is senior living, as far as I'm aware, although I'm not a lawyer.

The only age restriction allowed today is 55+ senior living communities. All adult went away in 1988 when Fair Housing laws changed.

Thanks for your replies. We are only wanting to restrict the age of the leaseholders. Some of our communities are 20+, some are 21+ (age to sign the lease, not to be an occupant). Since this is our first property in TN, I didn't know if there was a local or state law disallowing this practice.

For example, at our 21+ community, we would not allow an 18 year old to rent the unit alone.

Does that make sense?

But wouldn't that also violate Fair Housing? If you are saying that an 18 year old is required to have a 21+ leaseholder, are you not placing different restrictions based upon age for that 18 year old relative to the 21 year old? I feel like you need to clarify this with a Fair Housing lawyer if you haven't already because if this turns out to be against Fair Housing, you have potentially a LOT of violations. (Don't mean to scare you, but it would be worth the cost to get clarification.)

Where in TN are you talking about? Statewide, anyone who is 18 or older can be a lessee. I suggest contacting Bobbi Turner, ([email protected] / 615-365-3047) at the Greater Nashville Apartment Association and I'm certain she can point you in the right direction for a definitive answer.

Simple answer. In America, The day a person turns 18 they are an adult.
