We want to know how to get disabled tenants to move out of a triplex. They are on a month-to-month after a 2 year lease expired a few years ago. The tenants do not want to leave. They have been good tenants, always paid on time, never complained. We just want to remodel the one unit since it has some issues and the tenants reported a mold issue. The mold remediation requires a wall to be ripped open and some of the cabinets to be removed to get to the remaining portions of the wall. If we have to pull those cabinets off, we figured might as well remodel the whole kitchen. The "necessary" repairs as stated by the remediation company will only take one day, plus 2 days for testing. However, we would like to do a thorough remodel which will take a couple weeks. Are we legally able to ask the tenants to leave permanently? Only one of them is on the original lease, she is disabled. She has carers stay with her to help with housework, shopping, security, cooking, etc. Some of them are also disabled and consider this their home. We aren't sure what protections the primary tenant or the carers (disabled or not) may have. We would appreciate insight from those familiar with the laws in San Diego, if possible unless this is simply a state matter. Thank you for your help.
