If an applicant is approved with a felony on their criminal background check - do we have to release that information to the community that a convicted felon is living on site and what the crime is?
I’m not aware of any law or ordinance or requirement other than Megan’s Law that would have us do that. As a matter of fact, I think it would be a case for invasion of privacy could be brought by the convicted person.
I agree with Doug. In Texas years ago I think there was a requirement for licensed real estate professionals to disclose a death/murder on a property. Just for grins, you might check state laws regarding any kind of felony disclosure. If they passed your criteria they should be privacy protected. And do not disclose a felon to anyone, like your FRIEND who lives on the property. Gossip can be very hurtful and could provoke some kind of complaint.
