Rent Collection - Personal Property Lien Form

June has been a tough month!!! At the beginning of June, I was 99% occupied and although May had to be one of my easiest collection months...June has been the hardest. This month I have 2 definite skips with one more potential skip. :(

I'd like to lien this resident's personal luxury items so that he has incentive to pay.

I'm in Louisiana. Does anyone have a lien form I can use to fashion one according to Louisiana Law?

I would very much appreciate it! :)

For two solid days, I have been trying how to file a landlord lien in Louisiana for non-payment of rent. It's not like it is in Texas! Soooo easy in Texas.

I've called the City Court, The District Court, The Louisiana Department of Justice, a Justice of the Peace and an attorney. At first I got the pingpong effect. With Courts referring me back and forth.

Then once I called the Attorney General's office in Baton Rouge, they referred me to my Justice of the peace. He had no knowledge of how to do this either.

In Houston...you just pull out your redbook...print out the form fill it out...Go to the unit...record the item descriptions...take the items and leave the documentation behind. Bring the items to a storage facility and wait for the tenant to come for their personal property and what do you know...They suddenly have their rent.

NOT SO IN LOUISIANA! FIRST YOU HAVE TO FILE SUIT....SMALL CLAIMS I GUESS...THEN IT GETS COMPLICATED.
ONCE YOUR RESIDENT HAS SKIPPED...BASICALLY YOU ARE UP THE CREEK WITH OUT YOUR RENT PAYMENT.

This is a sad state of affairs. Especially when I have residents who skip like it's water rolling off their back. It's been an interesting 2 days here in Louisiana!
