I have a dilemma at our apartment building. First floor tenant is smoking and has been warned to stop. Second floor blasts his music. Both are constantly fighting over their violations of their leases. What would you recommend? Let them figure it out or evict them both?
You're not a babysitter you're there to manage an asset, at the end of the day it's a business and neither of them are abiding by the rules they agreed to. Give them a final warning and if it continues show them the door
I would sit them down individually. Tell them "I am speaking to you about your violation, not theirs. I will take appropriate action regarding them, but if you continue to violate I will be forced to take action against you." Then give them the appropriate notice for the first written notice, so that your paper trail is well-documented, and follow-up appropriately.
Wow, thanks for the fast input. We have given letters to all of the tenants about violations of the leases (we have three tenants in this building) while only two have actually violated the leases. It settled down and now it's turning into "he said/she said" all over again.
Contact your attorney and have a meeting with both residents. Let them know if both issues aren’t sorted themselves then what they are both doing is impacting the peaceful living of other residents as well as the staff in mediating their problems. While eviction is not a solution, people don’t realize certain things are grounds for eviction.
I try not to evict as first option. In Illinois we use a 10 day which spells out the paragraph in the lease they are violating. They have 10 days to resolve the issue then if nothing changes-eviction is the next step-just remember paper, paper , paper-and document-letters you have sent, police reports filed if you don't document you could lose in court-make sure you have the paperwork to back your case. Judges seem to be turning pro-tenant not landlord.
Good Day GIVE THEM A TOTAL OF 90 DAYS, If your are the owner of the apartment bldg.I agree that you must evict BOTH TENANTS. DO NOT HESITATE,do not drag your feet, be serious.
