Can a tenant break their lease if they’re going to basic training? Technically they are going in “active duty”? Reading the military clause, it says if they’re active and have an order. You do have orders for basic training? Let me know your thoughts ?
Spouse of a Recruiter 12+ year and an RM. Federal Service Member Relief Act requires you to release; the terms are they give notice and pay the Next full months rent payment and then they are released. Recruiter can give you a letter from the command.
When my son went to basic training he took his orders/ letter into his apartment with his notice to vacate.
~He also did let the office know about it well before he needed to give notice to give them a heads up.
They get written orders and documentation is easy

Yes, you have orders to go to Basic Training. They were sworn in. Maybe able to avoid any notice requirements since the country is under State of Emergency. Call a lawyer hotline for further advise.
It’s a federal rule under the SCRA. You have to allow with proper documentation and a 30 day notice. You cannot enforce any penalties such as lease break fees or concession paybacks. You don’t have to have it outlined in your lease because every state must allow under the same terms.
Lori Doles-Manges not sure but State of Emergency for the country may rank above this act. Would love to know for sure since there are so many other things that have been overruled since the order went into effect
Debra Ann Jackson I would think so too but that is always my go to when it involves military. I really didn’t put time into researching just went to what I knew from experience. I noticed they even changed the name of it so there may be more changes to the policy.
