I have a resident retaliating against her non-renew occurring in October. It’s been a looooong year of complaints and retaliating against fellow residents. Now it’s being targeted at our office/property.
No major damage. Just bags of trash (all have contained cat feces) being left at our front door. I finally caught her on video.
My question is, would it be worth it to file an L/T and go about it that way? I plan on filing a police report on Monday.
In my opinion...depending on where you are..this is health and safety hazard..worth it for a 10 day notice..if the behaviour reoccur then you can serve the 2nd one and get her out sooner.
Dree Rdj were in SE PA and have an eviction moratorium through July 10th. Hopefully, since it’s not about rental payments we can go ahead with it ASAP.
Ashley Lynn eviction moratorium is only for payment related in my state...if a tenant disregard safety or health and jeopardize others well being is not included. Check with your attorney though for your state.
Moving forward, do not send the non-renew until the last possible second your lease allows....30 or 60 days. Might save you a little headache. Might be a good idea to call her in and have the conversation with visual aids explaining she clearly isn't happy there so you are willing to let her leave early without penalty. That usually puts them on the straight and narrow temporarily.
I would evict. Just make sure you have all your documentation to show in court. I just went to court for a lease violation at NH and was granted possession.
Have you issued lease violations? Depending on your state laws, most will allow you to evict due to breach of contract. If you have issued 3 lease violations, the 4th you can file an eviction for breach of contract. Continue to issue any lease violations for any violating of the contract and gather as much documentation for court, all violations, pictures, police reports, etc.... Judge will award possession. Most states, after 6 days, if she don't leave, you can file a writ of possession.
