I have 2 tenants who’ve not paid since April. They ignore all notices, calls, emails any type of communication. I’ve sent them lists of local resources for rent help. I’ve asked for proof of hardship, and sent over payment plan options.
Indiana all evictions are on hold.
How do you collect when you can’t get a line of communication open?

Any suggestions??

Check for occupancy. They may have skipped. If not continue to document and provide resources. When this moratorium is up and they haven’t paid time to evict. You would have done your part.

I second check for occupancy. We had a very tragic incident at one of our communities that would have been found much sooner if there were not a hold on evictions.

Send them a letter that politely and firmly Explains that All tenants are required to provide proof that their job has been affected by Covid in order to do deferment payments. And that when the eviction order is lifted you will be expecting payment in full and will not be willing to work out any type of payment plan and therefore they will be at the top of the list when the courts open back up. Unfortunately you cannot send any five day notice during an eviction ban. I would send it certified as well as snail mail so you have proof. I know it’s a huge pain. But include in that letter also what their current balance is. Sometimes seeing the BIG picture is a reality check. You might offer them the opportunity to move out before you file evection and you can always go after them in small claims court for back rent

Put an abandonment notice on their door, they usually call than also why cant you serve an eviction notice, we are able to as of Monday but i has to be a 30 day notice to vacate instead of a 3 day

I had to tell one guy, when this is over and you’ve been evicted, chances are you’ll be homeless because when I’m asked about your stay here, I’ll be honest... hope you have family that will take you in. He called me a few days later asking about these “resources”.

There are plenty of resources out there- surprisingly. I got one of them to agree to pay someone’s rent for July and August before August was even here. Here in Milwaukee one of the local organizations. So there is help out there people just need to not be lazy and look for it.

We are in MA and currently facing the same issue. We have to tread lightly because we were told by attorneys that too much contact could be considered harassment. We left a notice on one door who hasnt paid anything since the beginning of the year and when it wasn't picked up after a few days we had a constable go in and the unit had been abandoned. Just a thought.

The moratorium part of the cares act has expired so I would use this time to file file file. Cares requires a 30 day NTV.

Emily Parnell Halbert if a state has an eviction moratorium the 30 day cares act notice can not be sent until the moratorium is over. The moratorium supersedes the expiration date of the care act.

I’ve been sending notices, emails and texts every other day giving the tenant their amount due, payment options as well as numbers to local trustee and other resources. I have not done an occupancy check notice as I know the tenant is there I’ve seen them in the unit while I was posting the notice as well as they have called for ac issue.

Tonya Burton-Clark I would still post an abandonment notice / access notice. The possibility of you coming in may make them call.
If they called about the AC, did you ask them about rent?

We called the residents emergency contact. Basically they are not responding and want to make sure they are ok. Helped with some.
If no contact posted notice of inspection. That helped with a few
