Advice.
I Am in the process of evicting someone that has a past due balance but is also listing their home on Airbnb. I printed a paper and put on the door “eviction has been filed” after the of course proper actions.

My question is…. Am I wrong or is it harassment to put a letter on the door with the verbiage “eviction has been filed”?

I did it and assuming their guest saw it and now the “resident” is throwing a tantrum saying we’re harassing him.

I may have worded it a bit different "Eviction proceedings have started" ... it's not harassment - it's your job to collect and notify them of what is happening if they don't comply

Not harassment, but may violate privacy, check the laws in your city/state to be sure. We can't print eviction notices on colored paper anymore.

Would’ve worded it a bit differently. But a noticed slipped under the door is fine. Not harassment as long as it is the proper notice.

Once you file the courts will also post the documents as well. He is probably irritated that’s your ruining his “business”. I never understood why people think it’s okay not to pay rent and then run it like a business. He’s probably making so much money running it as an Airbnb.

I’ve tried. Airbnb is no help when you’re not the host. They’d make a note but then refer you to the host.

Looks like eviction is your only option for not non-payment and using the property as an Airbnb. I know our lease clearly states this is prohibited unless written notice is provided by us, the landlord. I would go ahead and send him a violation and reference that paragraph in the lease. Should be located in your community policies as well as under the “subletting”. This way you can use that when you go to eviction court. The new lease that just released with TAA is awesome and very easy to read. If you haven’t already check it out. They just completed today through bluemoon.

Amaze balls!!! Lol I printed the lease out, high lighted the paragraph, found their listing on Airbnb, screenshot it and printed it and sent it to their address via certified mail and also using it for the eviction evidence. It’s hard as a manager to hear the resident call and speak poorly to my team. That’s when I step in and…… Jesus take the wheel lol

I like to make mine say Unauthorized Occupants must vacate immediately!

Once you file an eviction you cannot post any additional lease violation notices.... that letter saying you filed the eviction is fine, but any additional official violation notices could potentially void your eviction!!! Don't post a 7 day notice.

It always depends on your state and the judge most times! Lol in Florida they are tenant friendly so attorneys will tell you not to send any additional lease violations, or charge any additional fees/fines unless it is the scheduled monthly charges for the next month, being the person is already in eviction and the lease appropriates for those scheduled charges. The idea is, once an eviction is filed(at least in FL) if u issue a lease violation a tenant can claim your singling them out, or trying to make the case against the tenant worse on purpose to kick them out... which your probably not!
Not sure your state, but maybe check with yr eviction attorney, to be safe, bc it sounds like they need to go!

We had a tenant who habitually rented his unit for Airbnb. It is against our lease agreements. I’m not sure if you have that listed in your leases but you could slap a lease violation on his door for that, the eviction and unauthorized occupants.

It’s not harassment. Simply point out all of the lease violations he’s breaking. Don’t let him intimidate you.

Also check your city. I was in Santa Monica at the time and they do not allow Airbnb’s because it effects the hotel industry. (People did it anyways but you can report them there as well).

Do not post notices where the contents are visible to other residents. They need to be in envelopes with unit # visible only. And no colored paper that will distinguish delinquent residents from others.

If you put it open face on the door for the world to read, I would advise against that. There's no need to humiliate people. We have no idea their circumstances. Our best practice is always sealed and concealed.

In my opinion- no. We use a letter with that verbiage and it also lists what their options are. Go to court, pay the balance in full or move out. We fold it so you can’t read without opening.
By the way- does your lease state no subletting? Isn’t that what an Airbnb is?

Yes. We tour the community. I’d never advertise evictions to prospective renters. Hell…. I get embarrassed when constables put the letters on the outside of the door lol but it’s the industry and nothing we can do.

Well you have to let them know but I usually have the attorney send them an official letter in the mail and put a copy in the door. We have to wait 30 days to see if they move. If they dont then file for a court date evict . But no, that is not harrassment.

That's very generous of you. I usually don't tell them and just wait for the constible's office to post. Those letters are much more in your face. But no, I wouldn't consider that harassment. I guess it would be if you posted it 3 times a week.

Does your lease stipulate no subletting? It isn't harassment to send a resident a notice informing them of policies.
