If a resident add-on to lease, and then the original resident moves out, does the add on have to move out of unit, due to was not an original HH member?
Bob decides to take in a roommate, and finds one on his own (Joe) that he likes. He asks Joe to complete an application with the property, to make sure he meets the property guidelines. When the property approves Joe as a roommate; they draw up the revised lease with BOTH names on it. No problem.
Let's take it a step further: 4 months later, Bob is offered a new job, or his employer moves his postiion such that relocation is necessary; but Joe wants to stay. They approach management and ask that Bob's name be removed from the lease when he needs to leave. Management draws up new documents for Joe to sign, without Bob's name.
Remember that when Bob moved in, he paid a deposit. In this case, I would have Joe pay Bob the deposit he paid; and have Bob sign a document assigning any refund for deposits paid to Joe. This document releases Bob's interest and responsibility to the property. These documnets effectively make Joe the new resident without the added costs of turning a unit; and I would consider that when renewal time comes around on the unit.
Just make sure the new roommate add-on knows they are moving into the apartment and accepting it as-is. Any issues I ever had with add-on roommates is when it's move-out time and they don't want to pay for damages that the roommate that moved out caused. We have a document that we make them sign stating they understand and accept the apartment as-is.
I agree with that.... However, Joe should be able to also see the move in inspection sheet that Bob signed; as well as common charges agains the deposit at move out.
