We know that disability was added to the protected classes for fair housing some time ago; does anyone know when addiction was added to the list of disabilities?
I have an Adult Protective Services worker that wants me to remove a caregiver that is a recovering addict. I am trying to explain to the case worker that fair housing does not allow me to deny the caregiver on that basis, especially when the caregiver is the resident's choice and not paid by IHSS or private insurance. This caregiver is the grandchild of the resident.
Obviously it's not a fair housing issue... but to give any advice on that we would have to know why APS was involved... is the caregiver harming the resident? Has the resident complained?
