I believe you can ask the resident to get rid of his pet. Read your animal addendum carefully and always call your attorney.

the resident with the aggressive dog should be held responsible. People don’t have dogs like that and not know it. My dog is and I’d never allow him in a dog park.

So sorry this happened. I experienced this same situation a few months back. With the help of our attorney, we filed an immediate eviction and had the resident removed in less than a week. Since the dog was registered and up to date on it's rabies, animal control refused to remove the animal. The resident had the option to self quarantine the dog.

Had this happen. Any damages are to be settled between the residents. 7-day to remove the dog. If that dog does it again and you didn’t take action you will have liability.

Make sure to get he resident who's pup passed away something nice for a remembrance.. something with a dog paw, or a look alike or something to show you care ..

As always, refer to the current lease for the resident with the attacking dog. Then an attorney, if necessary.

Call animal control. They will come remove and quarantine the dog. If the dog is authorized then the rest is a cival matter between tenants.

Yes you can. 7 day notice to remove animal. Then if they dont comply you can 7 day to evict. (Florida) your state may be different.

A dog is an extension of the owner/resident. If a human attacked another person they would have to leave immediately, same goes for pets.

That's not necessarily true. It would need to be investigated because the one dog could've provoked the other other one. Again, this is a cival matter to be handled accordingly.

I had this situation occur long time back, a St Bernard picked up a Poodle in its mouth; luckily the Poodle survived. We took a petition for an emergency eviction to court and in essence evicted the dog--the pound came and carried it off (although the servicemen were pretty pale with fear I might add). I believe this will be governed by the laws of your state, but we found the Judge to be sympathetic to our plea. On a side note, we required the resident to give us a 30 day notice to vacate since they were off lease, which was also stipulated.
