In their lease agreement to keep their area clean and free of debris. And finally, as my old boss used to say, your apartment begins and ends at your door, anything outside that door is on the apartment grounds, not your personal space. You can suggest having them keep their trash inside until there is enough to drive to the dumpster so only the resident has to deal with the trash and not the community.

Waste not properly disposed of, attracts unwanted pests and scavengers. As previously mentioned, please promptly dispose of all waste and do not store it outside of your unit. We appreciate your cooperation with our efforts to manage pest related issues and keeping “insert community name” clean and aesthetically pleasing for all to enjoy.
Kindly remind them that trash and it's odors are open invitations to pests that they do not want getting into their home. Please use the closest refuse station provided to ensure they don't receive unwanted pests guests.
We always had a trash note in our community rules and each resident signed it. Reason enough. If you don’t have that in the lease to make a copy, highlight and send to his/her door then tell him/her you will gladly have maintenance pick it up for $20 a bag. But butter them up in the letter first...we appreciate your concern and value you even though you stink.

Trash attracts pest and stray animals. I send a notice that any future violations will result in a $25 fine per bag plus the cost of pressure washing any concrete due to their trash leakage. Also be sure to send them a scan of their lease.
Part of the community policies which are contractual, state that in addition to health and sanitation codes, for the aesthetic value, good neighbor practices, and overall enjoyment of the community by all residents that the grounds be kept free of trash.
Call me, I can get you set up with door to door trash service. I can get you the bids you need for it. It is a revenue generator for your property. Case settled. I have several smaller companies that I help get in on bids. They don't have any stupid long term contracts either.
Send them a violation letter and quote the lease for the section that refers to trash and let them know this attracts vermin and spreads disease and she does not have a choice if she wants to comply or not.
Since it's YOUR trash, then we will place it back inside YOUR apartment for you to smell instead of your neighbors. Oh and it's not actually YOUR apartment it's (Insert Management Company Name) you just rent it from us. Bhahahahaahaha.....do not say that lol.

Trash brings animals, bugs, it’s unsightly -ultimately refer back to your lease and the governing provision that states that you have the right to decide what is allowed and what is not and of course write a polite letter explaining it. Some people Think the rules do not apply to them. SMH
isn't there a clause in the lease about not leaving trash out? If they don't want to run to the dumpster every time they have a bagful then keep it inside until they are ready to take it. If that creates a bug or rodent problem they can pay for it
We charge 75$ per occurrence. First call is a courtesy reminder then we charge. If the same bag sits for 3 days we charge 75$ per day It’s in our lease agreement

I might have started with a friendly reminder of the trash policy and pest control to cut off this childish response. Just curious how far the dumpster is from this persons apartment? Are we talking blocks? What is to prevent this person from disposing of their own trash? Would he be okay with everyone leaving trash outside??
People can really be jerks when they feel called out for what they know is wrong. That’s why I usually try to use tactical mind games getting people to follow the rules but making them think it is their idea

Dear resident,
You may not leave trash outside of your home due to animals/rodents. The trash could attract a stray animal or rodent and when they get into the trash it would be scattered and that would ultimately affect another resident, as well as our curb appeal. Again, please discard appropriately and refrain from further behavior.
Seriously People! An adult should not need an explanation why is unacceptable to leave trash out. Stop with the sensitive pandering to these idiots...
Tell him to call his mother to take his trash out, wipe his ass and make his bed for him... Ultimately, the parents of the resident are to blame for raising a slob!
$25 dollar fine will fix that problem! And the attitude too, perhaps! $50 for repeated offenders.
Also, is it stated on the community policies? All you would need is: “Do you remember when you signed that form stating that you received a copy of the community policies...???” It explains in detail a few of the many reasons why to NOT leave garbage outside!!!
It's unsightly, it stinks, it attracts unwanted animals and bugs and I bet it's against policy. It's not allowed by any resident and you can't make an exception to being okay for one resident.

Yes, it's more about the animals/rodents that that could attract and/or the smell. I would suggest they get a trash receptacle with a lid and the trash can be placed INSIDE that until she goes to the dumpster. This language is in our lease so there would be a lease violation plus (I'm in Indiana), I think it's a requirement or you could be fined. The first emailer was probably trying to be nice but I guess the respondent took it to be intrusive. You can always call the city to report it too - like I said in my state, you can't leave trash out like that.

I would quote the lease. Period. If it happens again, send another lease violation notice. When it happens the third time, send a termination notice. Stick a fork in it. You're done.
As for taking photos of her apartment?? Her space begins inside the door. With my attitude this morning I would find myself taking pictures every day, throughout the day. LOL
Dependant on the Lease clauses for Egress (City and State ordinances for barring Egress and emergency personnel access to the unit.
Dependant on the lease clauses for Tenant's responsibility to clean and take care of the property.
Dependant on the lease clauses for Tenants use and enjoyment of the Landlords property.
Read the lease and then explain it to the Tenant in person. Then if the problem persists, follow the lease remedies up to and including Eviction for Non Rent breach of Lease.
All answers to Landlord Tenant issues are mostly already addressed in the Lease language, but it you don't know the lease, you certainly can't uphold or enforce it.
Actually... yes, I WILL take pictures. You will be held liable for any costs involved regarding pest control, odor remediation, etc.
My guess (or hope) is that this would be in violation of one or more of their lease terms. If so, an eviction notice (for breach of lease) will hopefully get their attention.
As far as the 'details of the actual conversation'
-The resident states "MY driveway"... It's actually not "YOUR driveway". You are simply renting the space and thus cannot just "do what you want"
Curb appeal is a valid concern of ours, and we retain the right to put in place restrictions and rules that are in the best interest for your neighbors and the community.
lastly, we do not want to encourage others to see this behavior and emulate it, therefore creating a larger problem in the near future.
