Their rent is a little over 3k i believe, they didn’t pay February’s rent in 2020 and just let it slide lol. I actually had the marshal schedule the eviction the same WEEK the cdc letter was given in September.
Omg! I would never let them get that high. I have had 12 eviction through out covid. All you need to do is eviction for lease violation. Because I know if they don't pay their rent they always violate the lease. It just goes toge
I have one that is close to $19k. Reached her back ground and found she was fraudulent in app as well as no renters insurance, electric not in her name, and she is a felon. Sent her 7 day to cure that ends tomorrow. Haven’t heard a peep out of her. 7 day to get out will go out now. Crossing my fingers I can get this career criminal with over 30 previous evictions out of my community.
Fraud all the way. Most likely she used her child’s ss#. She lucked out due to Covid. This is a career for her. Like I said she has over 30 evictions in her 4-5 different names she has used over the years.
I understand all of the memorandums, but I look at it as theft if they have not been impacted by Covid and have these high balances. In Arkansas evictions are criminal, not civil. I think at this point it should be handled as walking into Wal-Mart and stealing thousands of dollars of stuff.
I have telling my residents for months, "you dont walk onto walmart fill up your basket and then say I dont have money to pay but I'm hungry so I'm not going to pay, or go to the gas station fill up your car and not pay. Why is it ok to keep living in an apartment and not pay? Its theft, pure and simple.
Have you sent them a termination of month to month agreement? I’m sure you haven’t renewed them with that balance so I would serve the term letter than file on hold over.
We filed for non payment in Feb 2020. They had a court date right around the shut down in mid March. The marshal had the Writ the same week in September as they presented then CDC letter so their status is just on “hold”. Idk what to do anymore!
Has this person contributed any sort of payments towards the balance? My guess is no. I don’t know what state you are in but VA says that new landlords will have to overlook that balance owed when checking credit, if the person CLAIMS it was related to COVID.
Had a couple close to $25k and convinced the owner to settle for 50%. Both took the offers and each on a payment plan for the balance; they are already 1/2 paid. Got possession of the units and rented. Sometimes you just got to cut the loss; they would never have been able to pay all of that back and stay current. Did a few settlements for less than 2 months owed rent as well. A handful ignored our offers and are waiting it out. Can’t win them all but creativity and owners who are willing to settle helps for sure.
I have many residents that are doing their very best to get the rent paid, 2 and three jobs, paying $275 out of a $ 300 paycheck, constantly calling charities for help. Then I have a few that are basically squatting. Not trying at all and totally unconcerned. I gave them 60 days owner wants possession and filed as quick as I could. I have 5 evictions pending.
Yes - these particular residents have a long history of delinquency, lease violations, etc. the same week we received word that the marshal was going to evict in September, we were presented the CDC order. I’m sure they think it’s hilarious!
No we directed them for assistance and the CDC letter clearly states they have to attempt to pay and find resources so you can challenge it in court. We did and we won
Is this in Mass? Send out a 30 Day Notice and accompany the letter with a notice from the CDC. If the debt hasn't been paid by the due date send them to court. My highest has been $20,000 during COVID and they are no longer tenants.
We had a similar one... lower rent but never paid January, rolled MTM in March. We went to court to argue that they don't meet the criteria of the CDC letter, and the Judge ruled against us but was clear that the CDC does not understand that typically you should not accept partial payments for rent. The Judge said that in not accepting partial payments, we were operating correctly, but that unfortunately the CDC order states we had to have done so.
We were able to convince them to move out by cutting the balance due in half and offering a 2 year payment plan. They chose to move out, and so far they have made each payment on time. By the time they moved out, somewhere around $27k.
Has anyone started reporting rent to the credit bureau? You can do it automatically and improves rent collection for those just "choosing not to pay" even though they just got a new car or new tv etc. Some residents want to take advantage of this and just don't care about the consequences. I would want to motivate those working to pay and if they pay on time it helps their credit score so it seems like a great solution!

We are still going to court on residents who filed the CDC letter. It includes a declaration letter that the resident must fulfill each aspect stated in the letter. Our attorney has been able to get judgement due to some of our residents not meeting all the requirements of the declaration. Reach out to your attorney he may have some answers. I am in Ohio. May be different for other states.
