Hi All - DELINQUENCY SOLUTIONS NEEDED. I have 20 residents who haven’t paid in 6 months and court hearings take 1.5 years from the date of filing. We have little recourse. Here’s what we’ve done so far….
We filed money judgemens to run parallel with eviction, provided debt relief offers in exchange for possession, rescinded their parking and restricted their access to amenities. Anything else (that’s legal) you can think of?
Well, I don't know what state you are in. Maybe cash for keys? It does not release them from the amount they owe or the fact that you are obtaining a money judgement. But you can offer them whatever cash amount you think feasible (drop in the bucket from 1.5 years of free rent) and make them sign a stip that they will be out by xx date.
Sherry Tompkins I like this idea. Offer to pay app/deposit, and $500 to move. Make them sign a clause they owe it back, but gives them a fresh start somewhere else
Katie Young however you want to structure it. I just did 3 evictions here in OC California. The judge literally told us all that we all needed to go out into the hallway and come up with a settlement because if we didn't settle he would find something to throw the eviction out (not in those exact words). He also told the defendants that if they agreed to a settlement, then he would make sure that the judgement was suppressed or whatever the legal term is (I can't remember at the moment) so that they could rent somewhere else without problems. So now I go to extra lengths when I am processing an application because I fear getting a bunch of applicants who will move in and not pay!!
P.S. Pretty proud of myself. Been at this property now about 6 months and took the delinquency from over $50,000 to $4,700. Got one more to go! RA still pending with city of Anaheim so I'm stuck for now but putting the pressure on pretty hard! I don't rest. If someone owes me $25 I am going to text, call, knock, post notices until they pay it!
What state ? Based upon your post I assume you asked for judgements with your evictions. Try filing small claims and just go after the money. Should take less time and make them uncomfortable
This is crazy. I can't believe your courts are still taking that long. We thankfully went back to normal. I couldn't imagine what you are going through. My only thought is to hang tough and do a non renew but then again if they didn't leave within the 30 days you'd be back to square one. Have you called your legal counsel and asked what they suggest? At some point you have to assume they are not paying their utilities either. Have you done a utility audit to ensure it's in their name and not the companies?
Nj is a tenant for life state and you can’t non renew. Bummer but true. what county are you in? Have you contacted the DCA to see if they have funds and can assist with payment? Our NJ property has been a nightmare to get a court case but we’ve gotten funds from DCA on most of them. Do you have a L&T attorney or someone that does multiple things?
