Does anyone know if you can sue both the resident (Student) and guarantor (parent) for failure to pay rent?

(Student)and guarantor(parent) for failure to pay rent?

I would sue the student first to keep it very clean. Get a judgement and than send a copy to parent/Gaurantor. If i sue both it may become cluttered in court.
Sueing student first keeps it clean. Than having to sue gaurtor later is easy. If you do it yourself. If u use attys. Sue both together to save on costs pleaee

I was told no years ago. I decided to then have them as a lease holder and that made all the difference. But now days I’m unsure. If you call Senex Law they can tell you.

Explain to the guarantor that it will go on their credit and see if they will pay before sending to collections. They may just not want to pay because they had an agreement and the child has not done their part.

If I recall, a guarantor is a higher obligation.
When you sue and win, if primary fails to pay, guarantor owns the debt with zero recourse.

Yes, Absolutely. That’s the entire point of a co-signer. They are fully just as responsible for the rent amount as the leaseholder. You sue BOTH for the entire amount.
