I evicted for health & safety after they were requested to clean up and did not comply. In Oklahoma.

Same in Texas. Give them written notice to clean up...first one I notice significant improvement, gave her another 30 to continue...she did! Win win. The second did not evicted and won.

This can definitely be sticky for the fact that hoarding is considered a disability, and so people with a hoarding disorder are a protected class under the Fair Housing Act. For this reason, property owners cannot evict a tenant based solely on hoarding!

It can be for safety issues, fire hazard, pest issue. Just make sure you have paper trail and pictures to back you up

See if you can get city/code compliance support in addition to Adult Protective Services. I’ve experienced this, and there are many resources to help the resident, including a full clean up, and additional health support.

Even though hoarding may be a disability, that doesn’t mean that you can’t evict someone for this conduct. You do, however, as a reasonable accommodation, need to work with the person and give them additional time to clean up, if it is reasonable to do so. Remember too, that not all hoarders are persons with disabilities.

When is lease up for renewal? Call health department to ask them to inspect We give residents notice to clean up and keep reinspecting. Sometimes churches help them.

Yes , sent 30 day notice owner wants possession and end of lease term ,no eviction required , just did not renew lease
