Parissa RiggsDoes your lease have a death clause? If not, make sure whatever you do in this situation, you are consistent in the future so you don't have a Fair Housing issue. If this was me, I'd release with a 30 day notice so they are out by 8/31 before the renewal lease would go into affect. Sometimes, being a good person and human, supercedes anything else. The existing resident is most likely going through a lot. Don't make this harder on them. Compassion and empathy go a long way in our industry.

Guest InsiderLawfully, If the renewal lease’s effective start date isn’t until 9/1/24, then they could cancel the renewal provided written notice of cancellation and then put in the required notice to vacate.
Mark TanguayNot only release without penalty, but also send flowers. I would allow a reasonable time for the roommate and family to gather belongings and moveout, then any expenses beyond what the security deposit covers is written off if necessary. Some will insist on paying though. Let them set reasonable terms. Death changes all the rules.

The owners instructed us to be extra kind and release. Return all deposits and no charges. Other time, owners asked us to file claim on their estate. And collect all charges as per contract.
