Nevada-death of a co tenant, prior to new lease start date, lease renewed effective 9/1/2024, death two days ago, ground for release without penalty?

Guest Insider Why is this even a question??? Just release them. Co-tenant probably also means friend, partner, confidante. I think they have more pressing issues than playing hard ball with their property management.

Guest Insider Yes, that would be the right thing to do if the remaining resident requests that. I am sure remaining in the home without the other would just be a constant reminder of the loss of the other person.

Parissa Riggs Does your lease have a death clause? If not, make sure whatever you do in this situation, you are consistent in the future so you don't have a Fair Housing issue. If this was me, I'd release with a 30 day notice so they are out by 8/31 before the renewal lease would go into affect. Sometimes, being a good person and human, supercedes anything else. The existing resident is most likely going through a lot. Don't make this harder on them. Compassion and empathy go a long way in our industry.

Guest Insider Lawfully, If the renewal lease’s effective start date isn’t until 9/1/24, then they could cancel the renewal provided written notice of cancellation and then put in the required notice to vacate.

Mark Tanguay Not only release without penalty, but also send flowers. I would allow a reasonable time for the roommate and family to gather belongings and moveout, then any expenses beyond what the security deposit covers is written off if necessary. Some will insist on paying though. Let them set reasonable terms. Death changes all the rules.

Yes absolutely. If ure managing for someone else, ur fiduciary to collect. So so hard. We have made difference from our own pockets. But on other times
The owners instructed us to be extra kind and release. Return all deposits and no charges. Other time, owners asked us to file claim on their estate. And collect all charges as per contract.
